Acceptable Use Policy

This Acceptable Use Policy (“AUP”) sets the rules for sending messages through Txtly. It exists to keep our platform trusted and our delivery reputation healthy with carriers, email providers, and Meta. Breaching this AUP can result in immediate suspension or termination. It forms part of our Terms of Service.

1. Consent is required

You may only message recipients who have given you consent to be contacted on that channel, consistent with the Spam Act 2003 (Cth) and equivalent laws. Do not message purchased, rented, scraped, or harvested lists. You must keep records of consent and provide them on request.

2. Identify yourself and honour opt-outs

  • Every message must clearly identify you as the sender.
  • Marketing messages must include a functional, free unsubscribe. For SMS, you must support and honour STOP (and similar) opt-out keywords. For email, include a working unsubscribe link.
  • You must process opt-outs promptly (and within any legally required timeframe) and never message a recipient who has opted out.

3. Prohibited content

You must not send messages that:

  • are unlawful, fraudulent, deceptive, or phishing;
  • contain malware or malicious links;
  • promote hate, harassment, violence, or illegal goods/services;
  • relate to content restricted by carriers or Meta (e.g. illegal drugs, certain financial, gambling, or adult content) unless expressly permitted and properly registered; or
  • infringe others’ rights or violate privacy law.

4. Prohibited practices

  • Spamming, including unsolicited bulk or repetitive messaging.
  • Spoofing sender identities or evading filtering, throttling, or opt-out mechanisms.
  • Sharing your account to send on behalf of unrelated third parties without our approval.
  • Sending to recipients with whom you have no consented relationship.

5. Channel-specific rules

  • SMS — comply with carrier and AWS End User Messaging requirements, use approved sender IDs, and honour STOP/opt-out. Australian sender-ID and content rules apply.
  • WhatsApp— comply with Meta’s WhatsApp Business Messaging Policy and Commerce Policy, use approved templates for business-initiated messages, and respect the 24-hour customer-service window.
  • Email — comply with anti-spam law and Amazon SES policies; maintain low bounce and complaint rates and authenticate your sending domains.

6. Deliverability and account health

We monitor bounce, complaint, opt-out, and abuse signals. We may apply sending limits, require verification, throttle, or pause sending to protect the platform and our providers’ accounts. Persistently poor metrics may lead to suspension.

7. Enforcement

We may investigate suspected violations and may suspend or terminate accounts, remove content, and report unlawful activity to authorities or our providers. We may act without notice where necessary to protect the Service or third parties.
